Privacy notice
The Department for Transport (DfT) is collecting personal data so that we can contact you and other relevant parties about the application for a Stopping Up Order under Section 247 of the Town and Country Planning Act 1990. We collect details of people who raise objections or give support to an application so they can be contacted by the applicant to resolve any objections.
What data we are collecting and how we will use it
We are processing this personal data:
- Name of the applicant or objectors and other relevant parties
- Telephone number of the applicant or objectors and other relevant parties
- Address of the applicant or objectors and other relevant parties
- Email address of the applicant or objectors and other relevant parties
- Any additional personal information volunteered by the applicant or objector as part of their application or objection
Personal data is required to contact applicants, objectors and other relevant parties about the status of the application or objection. Any additional personal information provided as part of an application
or objection may be used to assess the application or objection and help in the resolution of an objection.
We may also use contact information to get in touch with you about opportunities to help improve our service.
Our lawful basis for collecting your data
Under data protection law, the lawful basis for processing your data is:
Article 6(1)(e) - Public interest
Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
While we are not intending to process your special category data, should your responses include special category data (for example, information relating to your health), a further section of the UK GDPR applies:
Article 9(2)(g) – substantial public interest (with a basis in law)
Data sharing
Objections and the associated data will be shared with the applicant to allow them to resolve the objection.
You can request to anonymise your objection when you submit it. This means the Department for Transport will not share your name and address with the applicant and will act as a mailbox for future communication.
How long we retain the data
Your personal data will be kept securely by DfT and anonymised within 5 years of DfT closing the application.
